Waiver, Release, Acceptance of Responsibility and Acknowledgment of Risk
WARNING: READ CAREFULLY. THIS AGREEMENT INCLUDES A RELEASE OF LIABILITY AND WAIVER OF LEGAL RIGHTS AND DEPRIVES YOU OF THE RIGHT TO SUE THE STILLWATER PROFESSIONAL FIREFIGHTERS’ ASSOCIATION AND OTHER PARTIES. DO NOT SIGN THIS AGREEMENT UNLESS YOU HAVE READ IT IN ITS ENTIRETY. SEEK THE ADVICE OF LEGAL COUNSEL IF YOU ARE UNSURE OF ITS EFFECT.
IN CONSIDERATION of Stillwater Professional Firefighters’ Association allowing me (my child) to participate in “Boots & Bikes 09’” Poker Run/Motorcycle Ride, taking place on Saturday, May 30, 2009 (the “Event”), I, for myself (my child), and on behalf of my spouse, children, parents, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns, hereby agree to and make the following contractual representations pursuant to this Waiver, Release, Acceptance of Responsibility and Acknowledgment of Risk (the “Agreement”):
(I AM) (MY CHILD IS) EXPERIENCED IN AND FAMILIAR WITH THE OPERATION OF MOTORCYCLES AND FULLY UNDERSTAND(S) THE RISKS AND DANGERS INEHRENT IN MOTORCYCLING. I understand that riding a motorcycle on roadways open to the public is an inherently dangerous and risky activity, and that my participation in the Event exposes me to all such dangers and risks as well as the increased risk of riding in a group of motorcycle riders, and I assume the risk of the same when I participate in the Event. Further, I acknowledge and assume the risk that the Event may take place on roads that are in less than ideal condition for travel by motorcycle and in weather conditions that may be or become unfavorable and dangerous for travel by motorcycle. I also acknowledge and assume the risk that no effort has been made to certify any equipment or test the skills of any of the persons participating in the Event, which may expose me to the negligence of any such person. In light of all the forgoing, I am (my child is) voluntarily participating in the Event and expressly agree to assume sole responsibility for the safe and successful operation of my (her) motorcycle, and to accept the entire risk of any property damage or accidents or personal injury, including death, which (I) (my child) might suffer as a result of my (her) participation in the Event and further understand that (I) (my child) assume(s) all risks in participating in the Event.
As the operator, I (my child) certify(ies) that I am (she is) duly licensed and competent to operate a motorcycle in a safe manner and the vehicle is in a safe operating condition. I (my child) understand(s) that I will (she will be) be riding on public roadways and am (is) solely responsible to determine the operational characteristics of my (her) motorcycle while participating in the Event.
I (my child) further certify(ies) that I (she) will not be operating a motorcycle while under the influence of alcohol or drugs. Further, I acknowledge being advised to wear a helmet, protective clothing, and protective eyewear during the Event.
I hereby Release, Waive and Covenant Not to Sue, and further agree to Indemnify, Defend and Hold Harmless the following parties: Stillwater Professional Firefighters association, Sponsors, Venue and Property Owners upon which the Event takes place, and each of their respective parent, subsidiary, divisions, and affiliated companies, officers, directors, partners, shareholders, members, agents, employees and volunteers (Individually and Collectively, the “Released Parties”), with respect to any liability, claim(s), demand(s), cause(s) of action, damage(s), loss or expense (including court costs and reasonable attorneys fees) of any kind or nature (“Liability”) which may arise out of, result from, or relate to my (my child’s) participation in the Event, including claims for Liability caused in whole or in part by the negligence of the Released Parties. I further agree that if, despite this Agreement, I, or anyone on my behalf, makes a claim for Liability against any of the Released Parties, I will indemnify, defend and hold harmless each of the Released Parties from any such Liability which any may be incurred as the result of such claim.
I hereby warrant that I have read this Agreement carefully, understand its terms and conditions, acknowledge that I will be giving up substantial legal rights by signing it (including the rights of the minor, my spouse, children, parents, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns), acknowledge that I have signed this Agreement freely and voluntarily, without any inducement, assurance or guarantee, and intend for my signature to serve as confirmation of my complete and unconditional acceptance of the terms, conditions and provisions of this Agreement. This Agreement represents the complete understanding between the parties regarding these issues and no oral representations, statements or inducements have been made apart from this Agreement. If any provision of this Agreement is held to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
